Nine police officers accused of killing Baby Pendo in 2017 were on Monday arraigned in Milimani Law Courts are set to take plea next week.

The officer have also been charged with rape as a crime and torture as crimes against humanity for 2017 post-election sanctioned violence.

Justice Daniel Ogembo deferred the plea-taking to November 21 after defence lawyers raised objections to their clients being charged.

The lawyers argued that the court’s jurisdiction had been challenged.

Some 12 officers including commanders face murder charges of the 2017 post-election violence deaths in Kisumu.

Among the accused police officers; Titus Yoma, Titus Mutune, John Chengo, Linah Kogey, Benjamin Koima, Benjamin Lorema, volker Edambo, Cyprine Robi, Josphat Sensira, Mohammed Ali Guyo, Mohammed Baa and James Rono Kogey, Guyo and Baa were not present in court.

Justice Ogembo directed that they appear on November 21 for plea-taking.

He released the nine officers present on a personal bond of Sh200,000 on condition they will present themselves for plea- taking.

In the Monday’s hearing, the Kenya National Commission on Human Rights asked the court to consider the role of police commanders in baby Pendo’s murder.

In their submissions, the KNCHR, told the Milimani law courts that police commanders, though not present during the 2017 post-election crackdown in Kisumu, had a role.

“The court should not ignore the doctrine of command responsibility while making a determination,” they said.

Baby Pendo was six months old when she was killed in the wee hours of August 12, 2017.
