A man in Nairobi by the name Mark Ambei Mutongoi has been charged at Nairobi court for secretly recording Margret Wangari while she was in a washroom.

Mark Ambei Mutongoi has been charged at Nairobi court for secrecty recording Margret Wangari while she was in a washroom. According to the prosecutor, the complainant stopped at Rubis petrol station in westlands when she decided to use the lavatories. He followed and placed his cellphone next to the window where he recorded her, but the crime was caught on CCTV.

Details indicate that Mark Ambenyi Mutongoi used his smartphone to record Margret Wangari without her consent in a lavatory on October 7at Rubis petrol station in westlands. According to prosecutor Robert Ogallo,the event happened at 10pm when the complaint stopped by the police station to fill her tank along ojiji Road .he detained how Ambenyi placed the phone at the window and started recording the compliaint and it took CCTV footage from the petrol station to unearth what the accused had done unnoticed.

When wangari was informed what had happened, she recorded a statement at the parklands police station after which charges were initiated against Ambeyi. Statements from staff members at the petrol station were also taken and used as testimonies in the case.

The legislation was further strengthened by the Data protection Act as it restricts the use, collection and sharing of individual’s personal information. Given that we are in an era where images and videos shared on social media have the ability to cause unwanted grief, blackmail or character assassination thus recording someone without his or her consent is illegal.
