The High Court has quashed the decision by the Director of Public Prosecutions (DPP) to withdraw a graft case against Cooperatives Cabinet Secretary Wycliffe Oparanya.

Justice Benjamin Musyoki ruled that the process used by the Office of the Director of Public Prosecutions to review and terminate the case was irregular and unconstitutional.

The case relates to allegations that Oparanya received Sh56.74 million from directors of companies that were awarded contracts by the Kakamega County government during his tenure as governor.

The Ethics and Anti-Corruption Commission (EACC) had recommended that Oparanya face charges including conflict of interest, abuse of office, money laundering and conspiracy to commit corruption.

The court found that the DPP should have involved the EACC in examining alleged new evidence before reviewing its earlier decision to prosecute Oparanya.

Justice Musyoki consequently declared the DPP's July 8, 2024 decision null and void and quashed it.

However, the court did not order Oparanya's removal from the Cabinet, noting that his appointment had undergone parliamentary vetting and that there was insufficient evidence before the court to invalidate it.
