The Director of Public Prosecutions (DPP) has approved murder charges against five suspects in connection with the killing of renowned lawyer, university lecturer and author Mathew Kyalo Mbolu.
The suspects are politician Rose Mbithe Mulwa, her two children Chris Mulwa and Angela Mulwa, and two police constables, Julius Kipkoech Cheruiyot and Kennedy Kipkemei Borboroi.
The two police officers were arraigned before High Court Judge Diana Kavedza at the Kibera Law Courts on Thursday. However, they did not take a plea after the court ordered that they first undergo a mental assessment.
Justice Kavedza directed that the assessment be conducted at Mbagathi Hospital, with the resulting report expected to guide the court before the suspects formally respond to the murder charges.
The judge also ordered that Rose Mbithe, who is being held at Lang’ata Women’s Prison, and Angela Mulwa, who is also in custody, be produced before the court. Chris Mulwa, who is being held at Nairobi Remand and Allocation Prison, is also expected to be presented before the court.
The three are currently facing separate charges relating to the murder of Dr. Victoria Mutiso.
The five suspects are scheduled to take plea on October 27, 2026, subject to the court receiving the mental assessment report for the two police officers.
Mbolu, who was widely known in legal and academic circles, was allegedly attacked and killed in Nairobi on September 9, 2025. His death triggered investigations that have now culminated in the DPP approving murder charges against the five suspects.
The case will now proceed under the supervision of the High Court as the prosecution prepares to formally present its case against the accused.
