OPPOSITION CONDEMNS ARREST OF MP JOHN KAGUCHIA AS FREE SPEECH DEBATE INTENSIFIES Nairobi, August 3, 2026.

Detectives from the Directorate of Criminal Investigations (DCI) took Kaguchia into custody on Monday morning at the Royal Media Services (RMS) offices in Nairobi. The MP had spent the night at the premises after appearing on Inooro TV’s Kiririmbi show on Sunday evening, claiming that heavily armed, hooded officers in unmarked vehicles had surrounded the media house and erected roadblocks with the intention of arresting him.
Kaguchia is being investigated over remarks he made at a political gathering in Kieni Constituency, Nyeri County, on Saturday, August 1. Speaking in Kikuyu, he warned Mount Kenya residents against voting for President William Ruto in the 2027 general election, stating that those who did so would be tracked to their homes and “smoked out.” Authorities have described the comments as inciteful.
Kisii Senator Richard Onyonka criticised the manner of the arrest during an interview on Citizen TV. “The feeling I’m beginning to have is that we’re becoming more and more intolerant to what we say about others,” he said. Onyonka noted that about 40 officers brandishing AK-47s and multiple vehicles had waited outside the studios, adding that Kaguchia is a Member of Parliament who was unlikely to flee and that there must be a better way to handle such matters without justifying the original remarks. 

Embakasi East MP Babu Owino also issued a strong condemnation. “We strongly condemn the arbitrary arrest of Hon. Kaguchia by the government over his remarks. Some people may disagree with what he said, but in a constitutional democracy, disagreement is never a justification for arrest,” Owino stated. He emphasised that freedom of expression protects unpopular or critical speech and that the proper response is more speech, not repression.

Kaguchia, an ally of Democracy for Citizens Party (DCP) leader Rigathi Gachagua, maintained before his arrest that his comments had been twisted and that the matter fell under the National Cohesion and Integration Commission (NCIC). He said he had received no formal summons and was willing to appear before the commission. Regional DCI Commander Daniel Kandie confirmed that the MP would be taken to DCI offices for further questioning.
The remarks had earlier drawn criticism from Presidential Adviser Dennis Itumbi and Senior Counsel Ahmednasir Abdullahi, who called them undemocratic. Opposition figures and lawyers who stayed at the RMS premises overnight accused security agencies of intimidation. The arrest has intensified debate over political rhetoric and the boundaries of free speech ahead of the 2027 elections.
