A 36-year-old man has been sentenced to 20 years in prison after being convicted of defiling a 12-year-old girl in Seme Sub-County, Kisumu County.
The sentence was delivered by Magistrate Jocelyn R. Kimetto at the Kombewa Magistrate's Court following a prosecution led by Principal Prosecution Counsel Carolyn Kiptum on behalf of the Director of Public Prosecutions (DPP).
The court heard that the offence occurred on May 18, 2022, at around noon when the minor returned home from school to seek treatment after feeling unwell. She was staying at her aunt's home, where the convict also lived with his family.
According to evidence presented in court, the man allegedly carried the girl from the living room to a bedroom, where he defiled her. The prosecution further told the court that the incident was reportedly the fourth time he had committed the offence against the minor and that he had threatened to kill her if she disclosed what had happened.
The girl later informed her aunt, who took her to hospital for examination and reported the matter to the police.
During the trial, the prosecution presented three witnesses, including a clinical officer whose examination findings and the medical history were consistent with the alleged offence.
The accused denied the charges and claimed he had been framed by his wife. However, in her ruling, Magistrate Kimetto rejected his defence, observing that his explanation did not undermine the prosecution's case.
The court found him guilty of defilement under Sections 8(1) and 8(3) of the Sexual Offences Act, No. 3 of 2006. He was sentenced to 20 years' imprisonment and granted 14 days to appeal against the conviction or sentence.
