PROPOSED LAW WOULD FORCE M-PESA, AIRTEL MONEY TO REPORT CYBER INCIDENTS TO CBK

Mobile money providers including M-PESA and Airtel Money could be required to report cases of mobile cash theft and other major cybersecurity incidents to the Central Bank of Kenya (CBK).

The requirement is contained in the proposed National Payment System Bill, 2026, which seeks to strengthen oversight of payment service providers and protect customers from financial losses linked to cyber-related incidents.

Under the proposed rules, providers would be required to report material incidents involving the loss, unauthorised access or misappropriation of customer funds.

The proposed law would also give CBK greater oversight of how payment service providers respond to cybersecurity incidents and protect customer funds.

Providers that fail to comply with the reporting requirements could face administrative action, including fines of up to Sh1 million or possible revocation of their permits.

The proposed changes come amid growing concerns over mobile money fraud and the need for stronger safeguards as millions of Kenyans rely on digital payment services.

However, the reporting requirement is still proposed and should not be presented as an existing legal obligation until the Bill becomes law.
