WHAT NEXT FOR RIGATHI GACHAGUA AFTER HIGH COURT UPHOLDS HIS IMPEACHMENT? : Appeals, Ambitions, and the Road to 2027

What Next for Rigathi Gachagua After High Court Upholds His Impeachment?

Nairobi, Kenya – June 9, 2026

The High Court’s landmark ruling on June 8, 2026, upholding former Deputy President Rigathi Gachagua’s 2024 impeachment has shifted the focus from immediate reinstatement to a longer-term legal and political battle. While the court awarded him KSh 50 million in damages for a violation of his fair hearing rights, it declined to quash the Senate’s removal resolution, citing constitutional finality and the risk of dual incumbency with current Deputy President Kithure Kindiki.Gachagua’s legal team has wasted no time signaling the next phase. Lawyers, including Ndegwa Njiru and Kirinyaga Woman Representative Njeri Maina, have described parts of the judgment as disappointing and confirmed plans to appeal to the Court of Appeal. If unsuccessful there, the matter is expected to escalate to the Supreme Court. A notice of appeal has already been filed, with the team vowing to exhaust all legal remedies provided by the Constitution.

Gachagua had anticipated this outcome, stating days before the ruling that he was ready for any decision and would pursue appeals if necessary. Legal observers note that the appeals process could take several months or stretch into 2027, keeping questions about his eligibility for elective office alive. Until the highest court delivers a final determination, many argue he remains eligible to contest positions, including the presidency.

Despite the setback, Gachagua has not abandoned his presidential ambitions. He has repeatedly declared his intention to run in the 2027 General Election and is expected to leverage the narrative of political persecution to rally support, particularly in his Mt. Kenya stronghold. As leader of the Democracy for Citizens Party (DCP), he will focus on grassroots mobilization, recruitment, and forging opposition alliances with figures such as Wiper leader Kalonzo Musyoka.

Analysts expect increased rallies, media engagements, and regional outreach to convert the court outcome into political capital while urging supporters to remain calm and respect institutions. The ruling has sparked debate on its impact on 2027 dynamics. Some view it as a major blow that could sideline him, while others see prolonged litigation as buying time and keeping him relevant in opposition politics.

Challenges remain, including potential questions over eligibility if the impeachment is ultimately confirmed, the resource drain of extended court battles, and the Senate’s possible appeal against the damages award. In summary, while the High Court decision closes the door on immediate reinstatement, it opens a new chapter of appeals and intensified political activity for Rigathi Gachagua. His ability to navigate the courts while building a viable 2027 platform will define the next phase of his career. The full judgment is expected to provide further grounds for appeal, ensuring this saga remains central to Kenya’s political landscape in the coming months.
