Former Member of the County Assembly for Kegogi Ward in Kisii County, Kepha Sagina Nyakundi, has been convicted on six counts of providing false information and personation.
The conviction was delivered by Eldoret Chief Magistrate Mikoyan following the prosecution's presentation evidence by the DPP counsels.ย
The trial court found that Nyakundi deliberately misled both the Ethics and Anti-Corruption Commission (EACC) and a public entity by submitting falsified information and presenting himself using forged academic credentials.ย
He was further convicted of personation under the Penal Code.
In its judgment, the court held that the prosecution had adduced overwhelming evidence showing that Nyakundi was not the rightful holder of the Kenya Certificate of Secondary Education (KCSE) certificate he had submitted to the EACC in order to be cleared to contest for the Member of County Assembly seat in Kisii County.
Having been found guilty on all six counts, Nyakundi is now awaiting sentencing, which has been scheduled for October 29, 2025.
During the hearing former Kenyoro Secondary School Chief Principal Evans Angwenyi told Chief Magistrate Evans Angwenyi had told that Kefa was not his student.
Angwenyi told the Court that he was the Principal of the school between 1988 and 2018 but did not see Kefa in School.
The Court was also told that the accused used the fake KCSE certifiate to gain admission to Kisii University Eldoret Campus in 2007 to study a Bachelor's Degree in Commerce.
He also used the same document to gain admission to Jomo Kenyatta University of Science and Technology Eldoret Campus in 2015 to study for a Master's Degree in Finance.ย
