Assembly Concludes Public Participation on Governor Nyaribo Impeachment Motion

The Nyamira County Assembly is set to conclude public participation on the proposed impeachment motion against area Governor Amos Nyaribo.
Bonyamatuta MCA Julius Matwere had tabled the motion that seeks to remove Nyaribo from Office by way of impeachment pegged on two primary grounds.
Governor Nyaribo is accused of Gross Violation of the Constitution of Kenya and Other Laws and Abuse of Office.
on gross violation of the Constitution and other laws, Nyaribo is accused of deliberate Formal Engagement, endorsement and supply of unlawful, illegal and unconstitutional "Bunge Mashinani" against the CoK 2010, Article 176 (1) and the County Governments Act (CGA 2012) , Section 6A , 7B (2) and 14 (1)(a).
He is also accused of assenting the Nyamira County Supplementary and appropriations Bill 2024 without the approval of the County Assembly , against the PCM Act 2012 , CoK 2010 and the CGA 2012.
The Governor is alleged to appointed Dr Peris Oroko to the position of a County Executive without the approval, appointment of Nyamira and Keroka Municipal Board members without the approval of the assembly and appointment of the County Public Service Board (CPSB) selection Panel for the recruitment of the CPSB chairperson, Secretary and members without the approval of the assembly against the CoK 2010 and the CGA 2012.
The MCAs accuse Nyaribo of having failed to appoint the Chairperson, Secretary and members of the CPSB since July 5, 2025 against the CoK 2010 Article 235 and the CGA 2012 , Section 58 A (1).
He is also alleged to have failed to submit annual reports and deliver the state of the County address for two consecutive years against the provisions of the CoK 2010 , Article 183 (3) and the CGA 2012 Section 30(2) j and K.
The once former Deputy Governor is also set to answer to allegations of having failed to appoint and obey court orders regarding the appointment of Clive Ogwora as an Executive in the County against the Contempt of Court Act 2016 and the CoK 2010 , Article 159(1).
On the second charge of Abuse of Office, Nyaribo is accused of improper use of his authority in recruitment of Staff without an approved Budget by the County Assembly.
He is alleged to have appointed Kiriago Godfrey and Elmelda Nyaberi as Director Human Resource and Payroll Manager respectively without an advertisement and or fair and competitive recruitment processes.
The Governor who was being sought by EACC two weeks ago will also defend himself of misusing his office through Personal enrichment from receipt of irregular salary payment of Sh 5.6 million.
The Assembly accuses Nyaribo that through systemic Payroll fraud and Syndicate termed as the Sh 32 Milion payroll Heist, paid Rose Bosbori (an ECDE teacher) an amount of Sh 25 Million, Gladys Moraa (ECDE teacher) Sh 1M and Isaac Kerongo Sh 700 against the regulations of the PFM Act 2012 and Anti-corruption and economic crimes Act of 2003.
The North Mugirango born son of Nyamira is allegedly usurped the powers of the Auditor General and the CPSB through illegal payroll audit and thence demoted 254 staff against fair administrative action.
The motion will be debated and considered at the assembly plenary on Nov 25, 2025 at 10:00am as per the standing order No 62(4) of the County Government of Nyamira.
