DPP secures life sentence for a father in incest case against minor

The Nakuru Law Courts has handed a sentence of life imprisonment to an adult male offender convicted of the offence of incest contrary to Section 20 of the Sexual Offences Act No. 3 of 2006.

Prosecution, led by Adeline Rogito and Ismael Yunis, successfully established the case against the accused. 

A total of six witnesses were called, whose testimony and evidence demonstrated how the 12-year-old victim was defiled by the accused, who is also the father.

The facts presented indicated that on the November 9, 2024, at approximately 1200 hours, the victim was at home in the company of the accused. The accused ordered her to commit the act with him. 

Upon resistance from the victim, the accused hit her and forcefully committed the heinous act. He later threatened her not to tell anyone.

In sentencing the accused, Senior Principal Magistrate, V.O Adet, indicated that despite the offender being a first-time offender, the gravity of the crime outweighed the mitigating factors.

"The offence was committed against a vulnerable child within the sanctity of a family setting, constituting an aggravating breach of trust. The ultimate penalty of life imprisonment was deemed necessary given the brutality and the familial context of the crime," the rulling reads.
