Former MP Kemosi's statement allegedly linking Bosire to State House money attracts a demand notice

ODM Party National Treasurer Timothy Bosire through his advocate has written a demand letter to former West Mugirango MP Vincent Kemosi over an alleged disparaging statement.
Bosire wants an admission of liability for defamation arising from the said publication, together with a suitable and fitting apology to be approved by his legal team prior to publication.
Through M.O.M Advocates, the demand letters says such apology must be accorded the same prominence as the defamatory publication within 72 hours and as provided for under Section 7A of the Defamation act cap 36, Laws of Kenya.
According to the advocate, on or about August 24, 2025 Kemosi addressed the media allegedly hurling expletives against Bosire while speaking in the Kisii dialect.
The said comment was aired live on an FM radio and their Facebook page and was also shared on various social media platforms for maximum coverage.
"This has currently attracted viewership from over 5,000 people and has been shared widely as well," the demand letter reads in part.
The demand letter quotes the alleged disparaging statement as; “On Friday Timothy Bosire had a meeting in Kericho and he claims to have shared with Fred Matiang’i of the said meeting. We as team Fred, we have shared with him and Fred was not there. Again what Bosire said was false. Right now, everyone knows that the money Hon. Timothy Bosire used in the meeting came State House."

The counsel says that the words contained in Kemosi's aforesaid alleged slanderous utterances, were intended, calculated, contrived, and designed to mean, and were in fact understood to mean that their client is not a decent Kenyan, not an honest Kenyan, had corruptly acquired funds for the said function and is corrupt.
"The said utterances were calculated, intended, and designed to disparage and injure our client's character and reputation as a loyal son of the Abagusii community, the National Treasurer and Chairperson of Board of Trustees of the ODM Party, a devout Christian, a husband, a father, and a respected statesman within the Republic of Kenya."
Accordingly the utterances are said to have been egregiously false, untrue in tenor, words and effect, as Bosire never sourced for funds from State House as alleged and that Kemosi had failed to report the alleged corruption to the Ethics and Anti-Corruption Commission, the Directorate of Criminal Investigations or any other authority.
The utterances, Bosire's legal counsel says were reckless and malicious in the extreme, given that the former MP did not seek clarification from the ODM party treasurer before making the allegations publicly.
"The timing and medium of your media address were carefully chosen to ensure the widest possible circulation of your defamatory remarks, which remain available online to date. The remarks subjected our client to public hatred, ridicule, contempt, scandal, and odium; he has been humiliated, disgraced, and subjected to untold embarrassment and ostracism, for which he holds you fully, wholly, and personally responsible."
